T&D Agri GmbH, Wiener Straße 64, 3100 St. Pölten, FN 561428f, Landesgericht St. Pölten, (hereinafter referred to as "T&D Agri") collects, processes and uses your personal data in accordance with the following principles. This declaration is aimed at customers and interested parties of T&D Agri and its offers.

Personal data is all data that contains details of personal or factual circumstances relating to an identified or identifiable natural person.

Only those personal data are collected that are necessary for the offer, implementation and processing of the services of T&D Agri, or for the processing of which there is a legal obligation, or for which you have given your consent, or for which T&D Agri has an overriding legitimate interest.

T&D Agri processes the following categories of personal data:

  • Name
  • E-mail address
  • Country of residence
  • Date of birth and age (for age verification)
  • Address
  • Delivery address
  • User account data including credit balances, purchased products, data on transfers of products to other users, data on purchases/sales on the marketplace, data on third-party products posted
  • Content and recipients of messages and notifications sent via the portal
  • User entries in the system, IP address and time of access (see also point 9.)
  • Submissions in competitions, prize draws and other contests

T&D Agri processes your data for the following purposes:

  • Processing of the business relationship (management of the user account, registration process,
  • Use of the website, orders/purchases and their processing,
  • Product delivery, provision of services on the website,
  • Wine cellar presentation, calculation of costs and taxes,
  • Age verification for compliance with legal dispensing restrictions,
  • Sending advertising and marketing information for our services,
  • Optimization of the website, online advertising strategies and the portal,
  • Implementation and handling of competitions, prize draws and other contests, including notification and awarding of prizes.

T&D Agri processes this personal data on the following legal basis:

  • the use of the aforementioned general data is necessary for the fulfillment of the contract for the use of the T&D Agri website and the use of the services offered on it by you or the implementation of related pre-contractual measures (Art 6 para 1 lit b GDPR).
  • the use of the age/date of birth and the country of residence is necessary for compliance with a legal obligation to which T&D Agri is subject, namely compliance with the ban on the supply of alcohol to young people (Art 6 para 1 lit c GDPR).
  • Consent or overriding legitimate interest for marketing purposes (Art 6 para 1 lit a and f GDPR).
  • Consent or overriding legitimate interest for website and advertising optimization (Art 6 para 1 lit a and f GDPR).

Without the collection and processing of your data, it may not be possible to provide the services offered in full or at all.

1.1 Application documents

As part of your application for a job at T&D Agri GmbH, we process information such as your name, contact details, CV, references and other documents submitted by you. Special categories of personal data (e.g. health data) will only be processed with your express consent.

1.1.1 Voluntary nature of data provision

The provision of your application data is voluntary. However, we cannot process your application without this data.

2. rights of data subjects

As a data subject, you have the right to information about your personal data used, its origin and recipients and the purpose of the data processing, as well as a right to rectification, data transfer, objection, restriction of processing and deletion of incorrect or inadmissibly processed data at any time.

If there are any changes to your personal data, please inform us accordingly.

You have the right to withdraw your consent to the use of your personal data at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. Furthermore, the withdrawal of consent has no influence on data processing that is based on a different legal basis.

Your request for access, erasure, rectification, objection and/or data portability can be sent to the address of T&D Agri indicated in point 10 of this statement.

If you are of the opinion that the processing of your personal data by T&D Agri violates the applicable data protection law or your data protection claims have been violated in any other way, you have the option of complaining to the competent supervisory authority. 3. data security

Your personal data is protected by taking appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, unlawful or accidental access, processing, loss, use and manipulation.

Notwithstanding our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information that you disclose to us via the Internet may be viewed and used by other persons.

Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacker attack on e-mail account, interception of communication).

4. use of the data

We will not process the data provided to us for purposes other than those covered by the contractual relationship with you, by legal obligation or by your consent or otherwise by a provision in accordance with the GDPR. An exception to this is the use for statistical purposes, provided that the data provided has been anonymized.

4.1 Application documents

Your application documents will be processed in order to carry out the application procedure and, if necessary, to prepare an employment relationship. If you voluntarily provide additional data, we will rely on your consent.

5. transmission of data to third parties

Third-party services are used for the purpose of paying for products or services and executing transactions; however, T&D Agri does not transmit any personal data to these third parties, but the data processing takes place directly between you and the third-party provider.

With your consent, data is transmitted to third parties (Meta Platforms Ireland Ltd., Ireland; Google LLC, USA) for the purposes of website and advertising optimization due to the use of third-party tools as described in more detail in section 8 "Cookies" below.

Standard third-party cookies and services from companies based abroad and in the USA are also implemented on the website. These are used with your consent and personal data may then be transmitted to the US servers of the respective companies. The USA is not a safe third country and does not have a corresponding level of data protection within the meaning of EU data protection law. Recipients in the USA may also have to disclose personal data to security authorities due to the legal situation there. Data subjects cannot take action against this. It can therefore not be ruled out that US authorities and security services may process personal data for surveillance purposes, over which T&D Agri has no further influence.

When conducting and handling competitions, prize draws and other contests, T&D Agri may publish the content of the submission on the website or social media platforms (e.g. Facebook, X (formerly Twitter), Instagram), stating the name of the respective participant.

Apart from this, no data is passed on to third parties or transferred to third countries or international organizations.

6. disclosure of data breaches

T&D Agri wants to ensure that data breaches are recognized at an early stage and, if necessary, reported immediately to you or the responsible supervisory authority, taking into account the respective data categories that are affected.

7. storage period

T&D Agri does not store data for longer than is necessary to fulfill contractual or legal obligations and to defend against any liability claims.

Deletion generally takes place 5 years after termination of the business relationship. Data will only be stored beyond this period if there is a legal obligation to retain it.

The data required to fulfill the accounting obligations (§§ 190, 212 UGB) and tax law requirements (§ 132 BAO) are stored for 10 years in any case. In addition, in individual cases, data will be stored for a longer period until the end of a legal dispute or until the expiry of the warranty periods and the limitation periods in the event of the assertion of claims for damages, if this is necessary.

7.1 Application documents for a successful application

After a successful application, your data will be transferred to your personnel file and processed in accordance with the internal data protection guidelines.

7.2 Application documents in the event of a rejected application

We will delete your documents within 3 months of completing the application process. With your consent, we can keep them for up to 2 years for future jobs.

8. cookies

The T&D Agri website uses "cookies" to make our services more user-friendly, effective and secure.

9. server log files
